Finding the funds
Surplus proceeds may move through several different systems.
The correct recovery process begins by identifying who currently holds the money. That answer may change with time and with the existence of competing claims.
Stage one
The foreclosure trustee may still hold the funds.
After a nonjudicial foreclosure sale, the trustee reviews sale expenses and potential claims. Notices may be mailed to addresses found in the records. A former owner who has moved may not receive the first communication, so confirming the trustee and updating contact information can be important.
Stage two
The funds may be deposited with a California court.
If entitlement is uncertain or several parties assert interests, the trustee may seek to deposit the surplus with a court. A claimant may then need to file documents establishing identity, ownership, priority, and the requested distribution. Court procedures vary by matter and location.
Stage three
Older funds may be transferred to an unclaimed-property program.
Funds that remain unclaimed can eventually be transferred to a government custodian. A search result alone does not establish entitlement; the agency may require records connecting the claimant to the former owner and property.

- Confirm the sale date, purchaser, and sale price
- Review recorded liens and ownership documents
- Search available court dockets and government databases
- Contact the current holder for its claim requirements
